юрУбийство, совершенное с заранее обдуманным злым умыслом. К этой категории не относятся преступления, совершенные несовершеннолетним [ infant; minor] или душевнобольным. В современном американском праве отличается от простого убийства [ manslaughter] и других видов лишения жизни [ homicide]. В большинстве штатов квалифицируется по двум степеням - тяжкое убийство первой и второй степени [first degree murder, second degree murder]. В законодательстве Флориды принято три степени тяжести, Нью-Мексико - пять. К убийствам первой степени относятся умышленные и заранее обдуманные убийства, в том числе при отягчающих обстоятельствах; к убийствам второй степени - убийства, совершенные без оправдывающих обстоятельств [justification], достаточных причин [excuse] или провокации со стороны жертвы [sufficient provocation]
